Terms of Service

1. Agreement to Terms

By accessing or using the Forum@Work platform, website, and related services (collectively, the "Service") provided by Forums@Work, Inc. ("Forum@Work," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Forum@Work is a platform that enables organizations to create, manage, and track peer forums for employee development and team building. The Service includes web and mobile applications, AI features, analytics, and related tools.

3. Account Registration

To use the Service, you must:

  • Create an account with accurate, complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access to your account
  • Be at least 16 years of age

You are responsible for all activity that occurs under your account.

4. Subscriptions and Payment

4.1 Plans

The Service is available under various subscription plans (Starter, Business, Enterprise) with different features and pricing as described on our Pricing page.

4.2 Free Trial

New accounts receive a 14-day free trial with full access to plan features. No payment is required during the trial period.

4.3 Billing

  • Subscriptions are billed monthly or annually based on the plan selected
  • Prices are per user per month and may be subject to applicable taxes
  • All fees are non-refundable except as required by applicable law
  • We reserve the right to change pricing with 30 days' written notice

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Your data remains accessible for 30 days after cancellation, after which it may be deleted.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Share, distribute, or disclose confidential forum content without consent of all participants
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to harass, bully, or discriminate against any person
  • Upload malicious code, viruses, or other harmful content
  • Reverse engineer, decompile, or disassemble any part of the Service

6. Forum Confidentiality

A core principle of peer forums is confidentiality. By using the Service, you agree that:

  • Content shared in forum sessions is confidential and must not be disclosed outside the forum group without explicit consent
  • You will treat all personal disclosures with respect and discretion
  • Violations of confidentiality may result in removal from forums and termination of your account

7. Intellectual Property

7.1 Our Property

The Service, including its design, features, code, documentation, and branding, is owned by Forum@Work and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

7.2 Your Content

You retain ownership of content you create on the platform. By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

8. AI Features

The Service includes AI-powered features (meeting summaries, moderator coaching, analytics). By using these features:

  • You acknowledge that AI outputs may not be perfectly accurate
  • AI-processed data is subject to the same confidentiality and security standards as all other data
  • We do not use your forum content to train general AI models

9. Data Protection

We process personal data in accordance with our Privacy Policy. For organizations subject to GDPR, CCPA, or other data protection regulations, we offer Data Processing Agreements upon request.

10. Service Level

We strive to maintain 99.9% uptime. Planned maintenance windows will be communicated in advance. Enterprise customers receive an SLA with specific uptime guarantees and remedies.

11. Limitation of Liability

To the maximum extent permitted by law, Forum@Work shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

12. Indemnification

You agree to indemnify and hold harmless Forum@Work and its officers, directors, employees, and agents from any claims, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
